Creative Retainer – Terms & Conditions
1. Scope of Services
Creative services are provided on a retainer basis and may include graphic design, digital assets, revisions, and related creative work, as agreed within the selected retainer package and allocated hours.
2. Retainer Term
All retainers operate on a fixed 12-week term, commencing on the agreed start date. Services are delivered on a weekly basis throughout the term.
3. Retainer Packages & Hours
Clients may select from the following weekly retainer options:
3 hours per week
5 hours per week
8 hours per week
16 hours per week
Services are provided up to the agreed number of hours per week for the duration of the retainer term.
4. Fees & Payment
Retainer fees are billed weekly in advance.
Rates reflect a discounted hourly rate compared to one-off or standard hourly services.
Payment must be made in accordance with the invoice provided.
Services may be paused or withheld if payment is not received by the due date.
5. Use of Hours & Scheduling
Retainer hours are allocated on a weekly basis.
Unused hours do not roll over to future weeks unless otherwise agreed in writing.
Any work requested beyond the agreed weekly hours may be billed at the standard hourly rate or quoted separately.
6. Revisions
Revisions are included within the allocated retainer hours, provided they fall within the agreed scope of services. Additional revisions or requests outside the scope may incur additional fees.
7. Early Termination
If a retainer is terminated prior to the completion of the 12-week term, an early termination fee equivalent to two (2) weeks of the agreed retainer hours will apply.
All outstanding fees remain payable. Any completed work up to the termination date will be delivered once payment obligations are met.
8. Intellectual Property
Ownership of final deliverables transfers upon full payment of all fees. The service provider retains the right to display completed work for portfolio, promotional, or marketing purposes unless otherwise agreed.
9. Limitation of Liability
The service provider is not liable for any indirect, incidental, or consequential loss arising from the use of delivered work.
All third-party costs, including but not limited to website hosting, printing, plugins, software, or external tools, are the responsibility of the client and are not included in retainer fees.
10. General
These terms constitute the full agreement governing creative retainer services. Terms may be updated from time to time and apply to all active and future retainers unless otherwise stated in writing.
Design Packages – Terms & Conditions
1. Scope of Services
Design packages provide access to creative and design services for a fixed number of hours, as outlined in the selected package. Services may include graphic design, digital assets, revisions, and related creative work within the agreed scope.
2. Package Term
All hour-based packages must be used within six (6) months from the date of purchase, unless otherwise agreed in writing. Any unused hours remaining after this period will expire.
3. Packages & Hours
Clients may select from the following package options:
3 hours
5 hours
8 hours
16 hours
32 hours
Services will be provided up to the total number of hours purchased.
4. Fees & Payment
Full payment is required in advance of services being performed.
Fees are based on the selected package at the time of purchase.
Payment must be made in accordance with the invoice provided.
Work will not commence until payment has been received.
5. Use of Hours & Scheduling
Package hours are scheduled in advance based on project requirements and availability.
Unused hours do not carry over beyond the six (6) month validity period unless otherwise agreed in writing.
Any work requested beyond the purchased hours will be billed at the standard hourly rate or quoted separately.
6. Revisions
Revisions are included within the purchased package hours, provided they fall within the agreed scope of services. Additional revisions or changes outside the scope may incur additional charges.
7. Cancellations & Unused Hours
If services are discontinued before all package hours are used, no refunds will be provided for unused hours. All fees paid remain non-refundable once work has commenced.
